Brooklyn, NY (October 5, 2026) – One person was killed and two others were hurt early Monday when a fleeing driver’s car rear-ended a sedan on Ocean Parkway near Avenue S, touching off a chain-reaction crash in the Gravesend section of Brooklyn.

According to reports, the collision happened at about 12:10 a.m. on October 5. Police said a southbound Audi struck the back of a Toyota Camry, which spun across the roadway and hit a Toyota RAV4. The Audi and the Camry then left the road and crashed into trees along the parkway.

Authorities said the driver of the Camry was rushed to a nearby hospital and did not survive. A passenger in the Camry suffered serious neck and back injuries and was listed in critical condition, according to reports, while the driver of the RAV4 was treated for minor injuries. Police said the driver of the Audi ran from the scene and that the car’s license plates had been removed. Investigators were still looking for that driver as of Monday, and no charges have been announced. Any charges that follow would be allegations unless proven in court.

Our thoughts are with the family of the person who lost their life, and we hope the two people who were injured are able to make a full recovery.

What Are Your Legal Options After a New York Car Accident?

New York is a no-fault insurance state, so a driver’s or passenger’s own policy usually pays the first round of medical bills and lost earnings after a crash, no matter who caused it. Under Insurance Law §5102(d), an injured person can step outside that system and bring a claim directly against an at-fault driver when the injuries are serious, a category that covers bone fractures, significant disfigurement, and the permanent loss of use of a body part. In most cases, that claim has to be filed within three years under CPLR §214.

A hit-and-run adds a hard problem: there may be no identified driver to hold responsible. When the person who caused a crash flees and cannot be found, injured people often turn to the uninsured and underinsured motorist coverage on their own auto policy, which exists for this exact situation. A seasoned NYC car accident lawyer can work out which policies apply and preserve physical evidence and camera footage before it is gone. Money recovered in cases like these generally falls into two categories:

  • Economic Compensation: Covers measurable financial losses such as hospital bills, ongoing medical treatment, physical therapy, lost wages, and reduced future earning capacity.
  • Non-Economic Compensation: Accounts for less tangible impacts like pain and suffering, emotional distress, and loss of enjoyment of life.

Acting quickly matters. Surveillance video from nearby businesses and traffic cameras is often recorded over within days, and in a case built on finding an unknown driver, that footage can decide the outcome.
