Can You Sue Uber or Lyft After an Accident?

It may be possible to sue Uber or Lyft after an accident, but this depends on the many unique factors involved in your situation. Because New York is a no-fault car insurance state, you may be covered for certain damages—including medical expenses and a portion of your lost wages—regardless of who was at fault. If, however, the rideshare driver was to blame for the crash, you could have a claim against the rideshare company they work for.

Both Uber and Lyft provide insurance coverage during certain “driving periods.” These include the following:

  • Period 1: The rideshare driver has the app turned on and is waiting for a ride request but has not yet accepted one and does not have a passenger in the vehicle.
  • Period 2: The rideshare driver has the app turned on, has accepted a ride request, and is on the way to pick up the passenger (the passenger is not yet in the vehicle).
  • Period 3: The rideshare driver has the app turned on, has accepted a ride request, and is actively transporting the passenger to their destination (the passenger is in the vehicle).

During periods 1 and 2, Uber and Lyft offer coverage up to varying limits for bodily injury and property damage. During period 3, both rideshare companies offer up to $1 million in total coverage per accident. This means that, if you were a passenger who was injured in an Uber or Lyft accident, you could be entitled to up to this amount in compensation for your accident-related damages.

Bringing a third-party personal injury lawsuit against Uber, Lyft, or another rideshare company can be extremely challenging, as these entities take numerous measures to protect themselves from liability. However, you could have a case. Get in touch with the New York City rideshare accident attorneys at Keith D. Silverstein & Associates to learn more during a free initial consultation.

What Should You Do After a Rideshare Accident?

Like any other motor vehicle accident, rideshare accidents can lead to severe injuries, expensive medical bills, significant property damage, and other challenges. There are several important steps you can take to protect your safety, your rights, and your continued wellbeing.

After an accident with an Uber or Lyft, try to do the following:

  • Check yourself and others for injuries. If necessary, call 911. Even if you do not need emergency medical attention, you should still see a doctor as soon as possible after the accident.
  • Get the rideshare driver’s name, contact information, and insurance information, as well as the same information about the rideshare company they work for.
  • If anyone else was involved in the crash, such as another motorist or a pedestrian, get their name, contact information, and insurance information.
  • Take pictures of the scene of the accident, your injuries, damage to the vehicles involved, and other important things that could be used as evidence in a future personal injury claim.
  • Follow all of your doctor’s recommendations and advice regarding treatment and your physical recovery, including attending follow-up appointments and taking prescribed medications.
  • Avoid speaking to the rideshare company or its insurance provider if possible. Do not agree to a settlement or sign anything until you have first spoken to a lawyer.
  • Contact an experienced rideshare accident attorney, like ours at Keith D. Silverstein & Associates, as soon as possible.

By working with a lawyer, you put yourself in the best possible position when it comes to recovering fair compensation for your medical bills, lost income, pain and suffering, lost quality of life, and other damages. We encourage you to reach out to our team right away to learn how we can help.
