Compensation After a Vehicle Accident in Brooklyn

If you’ve been injured in a vehicle accident in Brooklyn, you may be entitled to seek compensation for the physical, emotional, and financial harm you’ve suffered.

New York follows a “no-fault” insurance system, which generally means that your own insurance provider will cover certain medical expenses and lost wages, regardless of who caused the crash. However, if your injuries meet the state’s “serious injury” threshold, such as significant disfigurement, a permanent disability, or substantial loss of bodily function, you may be eligible to step outside the no-fault system and file a personal injury claim against the at-fault driver.

Compensation in these cases can include:

  • Medical expenses: Hospital bills, doctor visits, rehabilitation, physical therapy, and ongoing treatment.
  • Lost income: Wages lost while you recover, as well as loss of future earning capacity if your injuries prevent you from returning to work.
  • Property damage: Repairs or replacement costs for your vehicle and personal belongings damaged in the crash.
  • Pain and suffering: Compensation for the physical pain and emotional distress caused by the accident.
  • Other out-of-pocket costs: Transportation to medical appointments, home modifications, or caregiving expenses.

It’s important to keep all medical records, receipts, and accident-related documentation to strengthen your claim. Because New York has strict deadlines for filing lawsuits, acting promptly can help protect your rights. Consulting a New York car accident lawyer can ensure you understand your legal options and maximize the compensation you may be entitled to receive.
